Parties to the Agreement:

This Agreement;

1. a) Aslı Mağazacılık ve Unlu Mamuller Üretim Anonim Şirketi (“ASLI” or “Company”), located at Erikli Pınar Açmalar Mevkii Y.Dudullu OSB Mah. 1. Cad.No:4 İç Kapı:1 Ümraniye/İstanbul, operating through the website asli.com.tr, and hereinafter abbreviated as “ASLI in the contract)
2. b)Residing at the address of Erikli Pınar Açmalar Mevkii Y.Dudullu OSB Mah. 1. Cad.No:4 İç Kapı:1 Ümraniye/İstanbul, asli.com.tr, and the internet user (hereinafter abbreviated as "Member" in the agreement) residing at the address to be specified by him/her to the internet site asli.com.tr, have been accepted by mutual agreement between them. All of the regulations below, including the matters specified as asli.com.tr, have been accepted as valid for all virtual platforms including the Mobile Site, and The Member shall be deemed to have accepted this matter by approving this agreement.
3. Subject of the Contract:

This Agreement regulates the matters that the member can benefit from the services, products offered for sale, and privileges exclusive to members offered by ASLI on the asli.com.tr website and in return for the specified terms and fees, and that the Member can always cancel this approval and exit the system by giving notice at any time, and that ASLI can send notifications (including SMS, E-mail, voice call, direct call) regarding product and service promotions, campaigns and other commercial activities to the telephone and e-mail information provided by the Member upon approval of this Agreement.

3. Terms of the Agreement:

3.1. Protection of Personal Data and Privacy

The data provided by our customers who make transactions through the asli.com.tr website or mobile internet site, request sending of bulletins, campaigns and promotions and the like, carry out membership transactions, make purchases, and some personal information (name, age, areas of interest, e-mail, etc.) are used only within Eksim Yatırım Holding A.Ş. and its affiliates and processed by ASLI with the consent of our customers and in accordance with the provisions of the legislation, in order to provide better service to our customers, to design periodic campaign studies, special promotional activities aimed at customer profiles, and in customer “classification” studies to prevent the transmission of unwanted e-mails. ASLI absolutely does not share the information it collects from membership forms with third parties, except for its affiliated groups, umbrella and subsidiary companies, without the knowledge or instruction of the member in question, does not use it for any reason other than its activities, and does not share it with 3rd parties.

In addition, the asli.com.tr web and mobile site belonging to ASLI is a site that uses cookies. A cookie is a file consisting mostly of letters and numbers that is stored on the internet browser or hard drive of the device being used and allows information to be obtained about the internet browsing of the device in question. In order to provide better service to asli.com.tr visitors and within the framework of its legal obligation, it will collect, process, share with third parties and store securely your browsing information, provided that it is not used outside the purposes and scope specified in this Explanation on the Protection of Personal Data.

Within the scope of the Law on the Protection of Personal Data No. 6698 (“Law”), as the data controller, the information provided by the Member, including the membership and shopping stages, will record, classify, process, store, update and protect within the framework of the legislation the Member’s personal data (unless otherwise notified by the Member and with the right to revoke the permissions given at any time, partially or in full, without any liability by the Member). 3.2. Any matter not expressly undertaken in this agreement cannot be interpreted as being against ASLI. Unless otherwise stated in writing by ASLI, ASLI shall have the right to demand the fees announced on the site for the products and services offered on the site.

3.3. ASLI has the right to change the asli.com.tr website or mobile site or mobile application addresses or brand at any time and without having to state a reason, and has the right to transfer member information to the new website, mobile application or mobile site after these changes.

3.4. ASLI is responsible for the products and stocks it offers for sale on its website, mobile site and virtual store and will not be obliged to re-produce or supply products that are out of stock or out of stock due to customer demands. Products in stores other than the virtual store and in the virtual store may differ in terms of stock and quality. In the event that the product in stock cannot be supplied and shipped to the Member due to insufficient stock due to system errors, intense member demands and other reasons, the Member accepts and undertakes that ASLI will not request a refund or procurement of the product for which the stock is insufficient/not supplied, as it acts in line with the Member's interests and will not refrain from shipping the product in stock without any disadvantage to the Member.

3.5. This membership agreement does not impose any financial commitment or liability on the Member. However, the Member will be obliged to pay the prices of the products and services that he/she will order from the asli.com.tr website and other related fees. No additional fee will be committed for membership.

3.6. ASLI may diversify its membership system after the signature of this agreement, create different qualified memberships under different commitments (GOLD membership, PLATINUM membership or under other different names), create membership types that are more comprehensive, have different features, include privileges, discount rights, are paid or have other commitments than the rights and membership features granted to the member party to this agreement, and these rights may be given to 3rd parties without any additional notification to the Member. In this case, the Member's membership will not be changed without his/her consent, without giving any other commitments, and no extra obligation will be imposed on the Member, but the Member will be able to change his/her current membership as he/she wishes by giving any other commitments or having other commitments. The Member will not be able to request to benefit from the services that are paid or have other qualities/commitments with his/her current membership without switching to a Membership that has other qualities/demands.

3.7. The MEMBER accepts that he/she has given clear and direct approval for ASLI to send notifications (including MMS, SMS, E-mail, voice call, direct call) regarding product and service promotions, campaigns and other commercial activities at any time within the framework of legal legislation to the mobile phone and other telephones and e-mail addresses he/she provided at the time of approval of this contract, and accepts that ASLI is a licensed commercial enterprise regarding the notifications sent in this regard.

The member declares and undertakes that the personal and other information provided while registering to the asli.com.tr website is true before the law and that ASLI will compensate for all damages it may incur due to the untruthfulness of this information.

3.8. The member cannot give the password given to him/her while becoming a member of the website asli.com.tr to other persons or organizations, the member has the right to use the password in question. For this reason, ASLI reserves all responsibilities that may arise and all claims and demands that may be put forward against ASLI by third parties or authorized bodies, and all kinds of compensation and other claims arising from the unauthorized use in question.

3.9. Üye, asli.com.tr  While benefiting from the services available exclusively to members on the website, the member accepts and undertakes to comply with the provisions of the legal legislation and not to violate them. Otherwise, all legal and criminal liabilities that may arise will bind the member completely and exclusively.

3.10. Üye, asli.com.tr  internet sitesini ve portal hizmetlerini ve hiçbir şekilde kamu düzenini bozucu, genel ahlaka aykırı, başkalarını rahatsız ve taciz edici şekilde, yasalara aykırı bir amaç için, başkalarının fikri ve telif haklarına tecavüz edecek şekilde kullanamaz, almakta olduğu hizmetleri 3.şahısların kullanımına sunamaz, kiralama veya satışa arz etme gibi ticari faaliyetlere konu edemez. Ayrıca, üye başkalarının hizmetleri kullanmasını önleyici veya zorlaştırıcı faaliyet (spam, virus, truva atı, vb.) ve işlemlerde bulunamaz.

3.11. The ideas and thoughts declared, written and used by members on the asli.com.tr website are entirely the members' own personal opinions and are binding on the opinion owner. These opinions and thoughts have no relation or connection with ASLI. ASLI has no responsibility for any damages that third parties may suffer due to the ideas and opinions declared by the member and for any damages that the Customer may suffer from the acts and actions of third parties during the use of the services.

3.12. ASLI shall not be responsible for any damages that may occur to member software and data due to unauthorized persons reading member data. The member has accepted in advance not to claim compensation from ASLI for any damages that may be incurred due to the use of the asli.com.tr website and portal services.

3.13. The member agrees not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal liabilities arising from this will be entirely the responsibility of the member.

3.14. The member who violates one or more of the articles listed in this membership agreement shall be personally liable for this violation in legal and criminal terms and shall hold ASLI harmless from the legal and criminal consequences of such violations. In addition, if the incident is brought to the legal field due to this violation, ASLI reserves the right to claim compensation from the member for non-compliance with the membership agreement.

3.15. ASLI always has the right to unilaterally delete the member's membership, delete the customer's files, documents and information when necessary. The member accepts this decision in advance. In this case, ASLI has no responsibility.

3.16. ASLI does not guarantee or undertake in any way that any information on the asli.com.tr website is accurate, complete, adequacy and up-to-date. The user cannot claim that the information and/or portal services on the website are incorrect or that they have suffered damage based on this information. ASLI may change, correct and/or remove the information and/or portal services in question at any time without prior notice and/or warning in any way. ASLI has taken every precaution to ensure that the website and portal services are error-free. However, no guarantee is given regarding existing or potential errors on the site.

3.17. ASLI, its board members, managers, employees, the persons who prepared the information and/or portal services on this site cannot be held responsible for any direct and/or indirect material and/or moral negative and/or positive damages, in short, any damages of any kind, under any name, arising from access to this asli.com.tr website, direct or indirect use of the information and services on the site.

3.18. asli.com.tr All materials and documents on the internet site, including but not limited to these, are the exclusive property of ASLI, and the copyright and/or other intellectual and industrial property rights related to these materials and documents are protected by the relevant laws, and these materials and documents cannot be used, acquired or changed by the member without permission. Other companies and products mentioned on this website are the trademarks of their owners and are also protected within the scope of intellectual property rights.

3.19. asli.com.tr The materials and documents on the website cannot be changed, copied, reproduced or republished by the member in any way.

3.20. ASLI tarafından asli.com.tr  internet sitesinin iyileştirilmesi, geliştirilmesine yönelik olarak ve/veya yasal mevzuat çerçevesinde siteye erişmek için kullanılan Internet servis sağlayıcısının adı ve Internet Protokol (IP) adresi, siteye erişilen tarih ve saat, sitede bulunulan sırada erişilen sayfalar ve siteye doğrudan bağlanılmasını sağlayan Web sitesinin Internet adresi gibi birtakım bilgiler toplanabilir.

3.21. ASLI may use members' personal information in order to provide better service to its users, improve its products and services, and facilitate the use of the site in studies that are specific to its users' preferences and areas of interest. ASLI reserves the right to keep records of the member's movements on the asli.com.tr website while receiving portal services.

3.22. ASLI may disclose the member's personal information when requested as a legal obligation or when it believes in good faith that it is necessary to (a) act in accordance with legal requirements or comply with legal processes served on ASLI or the ASLI website; (b) protect and defend the rights and property of ASLI and the ASLI website family.

3.23. Measures have been taken within the available means to ensure that the ASLI website is free from viruses and similar software. In addition, in order to ensure ultimate security, the user must provide their own virus protection system and provide the necessary protection. In this context, by entering the ASLI website, the member accepts that they are responsible for all errors that may occur in their software and operating systems and their direct or indirect consequences.

3.24. ASLI reserves the right to change the content of the site at any time, to change or terminate any service provided to users or to delete user information and data registered on the ASLI website, to remove products and to withdraw them from sale at any time.

3.25. ASLI may change, update or cancel the terms of the membership agreement at any time without any prior notice and/or warning in any form. Every changed, updated or repealed provision will be valid for all members on the date of publication.

3.26. The parties irrevocably accept and declare that all commercial books, e-mails, notes, electronic data, computer records and the like belonging to ASLI will be accepted as valid and proper evidence in accordance with Article 193 of the Code of Civil Procedure and that this contract is also an evidentiary contract.

4. Duration and Termination of the Contract:

This contract shall enter into force upon the declaration of acceptance by the Member. ASLI shall be deemed to have accepted the contract by presenting it to the Member, however, contracts not approved by the Member shall not be used against ASLI.

This agreement will remain in effect until the member cancels his/her membership or until ASLI cancels his/her membership. In the event that the member violates any provision of the membership agreement, ASLI may unilaterally terminate the agreement by canceling the member's membership.

5. Dispute Resolution:

Istanbul Anatolian Courthouse (Kartal) Courts and Enforcement Offices have jurisdiction over disputes regarding this contract.

6. Force:

The member's registration for membership means that the member has read all the articles in the membership agreement and has accepted the articles in the membership agreement. This Agreement has been concluded with the approval given by the member at the time of becoming a member and has entered into force for the parties. It is sufficient for the member to give approval electronically and there is no need for the member's wet signature.
